美司法部欲加重刑期至3年 赵长鹏161封支持信曝光

继去年与美国的天价和解后，赵长鹏(后简称“CZ”)再次来到了风口浪尖。

本以为缴纳了高达43亿美元的罚款与1.75亿美元保释金后，盛极转身的CZ有了千金难买的自由，但司法部强硬的态度，却让原本的刑期问题变得更为复杂。

此前，根据认罪协议与联邦指导方针，CZ可能将面临12-18个月的刑期，美国缓刑部门则建议CZ应入狱五个月。但在Arthur Hayes的前科之鉴下，多数行业人士均认为居家监禁会成为最终结果。

但目前根据法庭文件，联邦检察官认为，该案涉及洗钱金额巨大，而CZ未能在币安实施有效的反洗钱计划，非法行为者以各种方式利用币安的交易所，包括运营隐藏加密货币来源和所有权的混合服务；交易勒索软件攻击的非法收益；以及转移暗网收益市场交易、交易所黑客攻击和各种与互联网相关的诈骗，以上均是CZ明知币安罔顾法律却还暗中默许，因此其应加重刑罚被判处三年监禁，并罚款5000万美元。检察官强调，CZ和币安将美国客户、美国金融体系和美国国家安全置于危险之中。

此决定也并非空穴来风，美国方对CZ的管控一直十分严格，始终将其留在美国境内，表达了对其的高度不信任，不仅要求CZ在美国境内各州之间旅行之前必须通知审前服务部门，他还必须在律师的监督下将加拿大护照交给第三方保管人，同时上交“所有其他有效和过期的护照和旅行证件”。未经法院许可，他也不能“从任何国家”申请新护照或旅行证件。

无独有偶，3月28日，SBF案也落下帷幕。美国地区法官Lewis A. Kaplan在曼哈顿联邦法院最终宣判，SBF因FTX交易所涉嫌串谋诈骗、串谋洗钱等七项罪名，被判处25年监禁，并没收超过110亿美元的资产。

原本预计110年的刑期缩短为25年，而对行业作出巨大贡献、在FTX事件中推波助澜且一直秉持着合作态度的CZ刑期却要加重，这也引起了行业众多人士的不满，甚至有人在X平台称这是一种霸凌。

当然，即便联邦检察官如何申诉以及建议，实际上均是美国检方原告观点，量刑只代表上限，作为被告的CZ也并不会束手就擒，双方仍在博弈中，最终结果尚待后续庭审。CZ的辩护律师就直言，CZ不应被判入狱，而应被判处缓刑，辩称其已经承担了犯罪责任从迪拜来到美国接受审判，而且CZ本人并未参与洗钱、欺诈与盗窃，表示CZ打算捐出90%至99%的财富投身慈善。此外，对于违反美国制裁法一项，美国用户与受制裁国家的交易对手之间的随机、自动交易仅占币安总交易量的很小一部分（0.00041%），以此指控CZ故意为之十分牵强。

而在公开的庭审文件中，CZ的亲朋好友、合作伙伴以及币安客户撰写了161封支持信也引起了圈内热议。信件从不同的身份与角度对CZ进行了还原，均表明了希望法官宽大处理的核心。
