腾讯财付通：关闭一家真实交易指向比特币等“二元期权交易平台”商户的支付权限

9月28日，腾讯旗下支付公司财付通发布风险警示称，过去一段时期，人民币汇率波动较大，外汇市场异常活跃。一些非法二元期权平台以“易操作、回报高”为诱饵，向国内投资者推销“互联网金融理财产品”。这类产品的普遍特征是结构复杂、分销过程不规范、监管难度较大，且具有较大的投资风险。

On September 28, pay-for-company money under the flag issued a risk warning that the renminbi had fluctuated considerably over the past period and that the foreign exchange market had been unusually active. Some illegal binary options have been used as bait to sell “Internet financial property” to domestic investors. These products are generally characterized by complex structures, irregular distribution processes, more difficult regulation, and high investment risks.

财付通表示，近日，在日常交易监测和风险排查中，财付通公司风险管理部门发现一家服务类公司高度可疑，单日交易金额大，但与该公司实际业务严重偏离，且交易过程中存在大量可疑行为。经深入分析，其真实交易指向某“二元期权交易平台”（见下图）。经核实，该平台为外汇、股票、比特币二元期权交易，属于我国法律明令禁止的网络炒汇和外汇期货行为。核实确认后，财付通关闭了该商户的支付权限，制止其继续进行非法交易。

In recent days, in the monitoring of daily transactions and risk check, the Treasury Risk Management Department has found a service company highly suspicious, with a single-day transaction amount that deviates significantly from the company's actual business and involves a large number of suspicious transactions. After an in-depth analysis, the real deal points to a “dual trading platform” (see figure below). It has been verified that the platform is for foreign exchange, stock, and bitcoin options, which are prohibited under the laws of the country. After verification of the confirmation, the Treasury shuts down the payment authority of the firm and prevents it from continuing its illegal transactions.

根据《关于严厉查处非法外汇期货和外汇按金交易活动的通知》等法律法规，未经批准擅自开展外汇期货和外汇按金交易的行为均属于违法行为，参与双方不受法律保护。与此同时，2016年，证监会发布的针对二元期权平台风险警示中也明确，互联网二元期权平台交易行为类似赌博，已有地方公安机关以诈骗罪对二元期权网络平台进行立案查处。

In accordance with laws and regulations such as the Circular on the Strict Investigation and Punishment of Illegal Foreign Exchange Futures and Foreign Exchange Cash-Based Transactions, the conduct of foreign exchange futures and foreign exchange-based gold transactions without authorization is illegal and is not protected by law. At the same time, in 2016, the CSRC issued an alert on the risks of binary options platforms.

财付通指出，投资者参与网络炒汇和外汇期货（含二元期货），不仅违法，而且面临较大的资金风险。二元期权交易同时具有两大风险，其一是，交易平台多注册在境外，服务器也在境外，在境内没有实体营业地或者可供执行的资产，一旦服务方违约，投资者在国内起诉无门，无法保障自身权益。

The FSB states that investors are not only against the law, but are also exposed to greater financial risk by engaging in network exchange and foreign exchange futures (including binary futures). Two major risks are associated with binary options transactions, one of which is that the trading platform is more than registered outside the country, the server is also outside the country, there is no physical place of business or enforceable assets in the country, and once the service provider defaults, the investor has no access to domestic litigation and is unable to safeguard its interests.

此外，国内投资者对标的资产走势的判断，决定了获利或亏损的结果，本身也存在投资风险。

In addition, the judgement of domestic investors as to the direction of the subject asset determines the outcome of profit or loss, and there is investment risk in itself.

财付通表示，积极配合国家外汇管理部门，严厉打击网络炒汇和外汇期货违法犯罪活动，并提醒用户通过合法途径进行外汇交易，远离非法外汇期货交易。

The Treasury indicated that it was actively cooperating with the national foreign exchange authorities in order to severely combat the criminal activities of cyberbilling and foreign exchange futures, and to alert users to the fact that foreign exchange transactions were carried out through legal channels and away from illegal foreign exchange futures transactions.
