针对南通市经济技术开发区互联网企业、科创企业云集的特点，日前，南通市经济技术开发区检察院举办了“检察护企开放日”互联网企业专场。活动中，该检察院检察长吴晓栋介绍了一起以区块链技术、去中心化金融、加密货币等科技名词为幌子的组织、领导传销活动案，引起了在场企业人员的关注。

2020年9月，通过炒币赚到第一桶金的徐某结识了同样混迹于“币圈”的黄某、杨某、陈某，黄某精通区块链技术，杨某是程序员，陈某精通英语。4人一拍即合，决定开发“第二地球”平台，并发行自创的虚拟币SET币。为提高推广效率，4人采用拉人头的传销模式进行宣传推广：平台会员以泰达币（一种挂钩美元的虚拟货币，1泰达币约等于1美元）充值兑换SET币，使用SET币购买不同等级的充能舱后，可通过发展下线获取相应收益。

In order to increase the efficiency of the promotion, four people promoted and promoted the distribution of headlines: the platform’s members exchanged SET currency with the equivalent of tadar (a virtual currency pegged to the dollar, with a tadar equivalent to about US$ 1), using SET currency to purchase different classes of plentiful modules, and the corresponding gains could be obtained through the development of a lower line.

没多久，该项目不仅在国内“币圈”迅速走红，还依靠陈某出色的英语水平打开了海外市场。短短两年时间，参与人员就多达7万余人，达到1302层级，涉案金额超1亿元人民币。2022年11月，炒币爱好者王先生经推荐参与“第二地球”项目，后发现无法提现，便报了警。2023年5月，公安机关将该案移送我院审查起诉。

In November 2022, Mr. Wang, who was recommended to participate in the Second Planet project, called the police. In May 2023, the public security organs referred the case to our court for review and prosecution.

要准确定性网络技术犯罪，首先要搞清楚技术原理。为此，我们组建办案团队，系统学习了区块链知识，并就技术问题多次与专业机构沟通，厘清了“去中心化”“公链”“挖矿”等概念。在此基础上，我们通过一系列证据，证实SET币是没有任何价值、不可在“公链”流通的无实体项目支撑的虚拟货币。徐某等人以推广SET币为名，要求平台用户购买充能舱获得加入资格，并通过发展下线方式获取收益的行为，涉嫌传销犯罪。

For this reason, we set up a case team, systematically learns about block chains and communicates many times with specialized agencies on technical issues, clarifying concepts such as “decentralizing” the public chain and “mining”. On this basis, we have established, through a series of evidence, that SET is a virtual currency supported by an entity project that has no value and cannot circulate in the public chain.

解决好案件定性问题后，再解决定量问题。辩护人提出了“泰达币属于虚拟货币，不是法定货币，不具有法偿性（指法律认可的货币对特定范围的债务具有法定偿付能力），不能以泰达币的价值认定平台所涉传销数额”的辩护意见。对此，我们开展自行补充侦查，一方面借助专业技术公司开发的区块链浏览器，自行查询、调取犯罪嫌疑人电子钱包的交易记录，查明徐某在案发前从平台转入个人钱包42万余枚泰达币，准确认定其违法所得；另一方面通过梳理上千页银行流水，查明黄某使用违法所得投资赚取人民币数百万元，并向其家人转账人民币766万元。

The defense argued that “Tedar is a virtual currency, not a legal currency, not a legal one, and that there is no legal settlement (i.e. a legally recognized currency has a legal solvency for a specified range of debts) and that it is not possible to determine the amount of the proceeds of the sale involved in the platform in terms of the value of the Teedar currency.” In response, we conducted our own supplementary investigations, on the one hand, by means of a block-chain browser developed by a specialized technology firm, to search for and retrieve the records of the transaction of the suspect's electronic wallet, and to identify Xu's transfer from the platform of more than 420,000 tada's wallet and to accurately identify its illegal proceeds; and, on the other hand, by combing thousands of pages of bank fluids, to find that the yellow had earned millions of yuan from the illegal investment and to transfer 7.66 million yuan yuan to his family.

为及时追缴赃款，我们决定在确保资金、交易安全的前提下，聘请专业公司对暂扣的泰达币、以太币等虚拟货币先行处置变现，得款人民币2884万元。同时，我们通过释法说理，引导被告人家属退赃人民币500余万元，4名被告人均自愿认罪认罚。至此，检察环节实现追赃人民币4000万元，判决生效后均已上缴国库。

2023年9月，我院以涉嫌组织、领导传销活动罪对徐某等4人提起公诉。同年12月，法院以组织、领导传销活动罪分别判处徐某等4人六年至五年六个月不等有期徒刑，各并处罚金。

In September 2023, the court indicted Xu Fong and four others on suspicion of organizing and leading distribution activities. In December of the same year, the court sentenced Xu Fong and others to prison terms ranging from six to five and six months, each with a fine.

案件办结后，我院将该案制作成动漫短片，在图书馆、商场、写字楼等循环播放，提醒想要涉足“币圈”的年轻人切实防范各类打着技术创新幌子的新型网络犯罪。

Following the completion of the case, the court produced a moving short film, which was broadcast around the library, the mall, the writing hall, etc., reminding young people who wanted to get involved in the “currency circle” to effectively prevent new types of cybercrime under the guise of technological innovation.
