泰达币、比特币、FIL币......无锡高新区检察官：买卖虚拟币需谨慎

　　泰达币（英文名：USDT,又称U币）、比特币、FIL币等一系列虚拟货币，具有非货币当局发行、使用加密技术及分布式账户或类似技术、以数字化形式存在及不具有法偿性等主要特点，通常是点对点匿名交易，隐蔽性好、缺乏监管，往往容易滋生违法犯罪活动，危害人民群众财产安全。

The main features of the series of virtual currencies, such as the non-monetary authorities, the use of encryption and distributional accounts or similar technologies, the existence of digitalized accounts and the absence of legal compensation, are often anonymous transactions at points, good covertness and lack of supervision, often leading to criminal activities and endangering the property of the population.

　　近日，江苏省无锡市新吴区人民检察院提起公诉的一起利用虚拟币实施诈骗案件一审宣判，被告人王某某被判处有期徒刑一年六个月，缓刑二年，并处罚金人民币二万元。

In recent days, a first-instance judgement in a case of fraud by using virtual currency was handed down by the people's procuratorate of Noi Wu District in Jiangsu province, who initiated a public prosecution, sentenced one of the accused, Wang, to one year and six months'imprisonment, two years'suspended sentence and a fine of 20,000 yuan yuan.

　　家住本市新吴区的张女士热衷于投资虚拟币，经常在火币交易所等平台买卖FIL币、泰达币，因此结识被告人王某某，且两人均在投资虚拟币同好微信群内。2021年6月的一天，张女士在微信群内发布了一条求购泰达币的信息，王某某在微信群内看到上述信息，生出诈骗张女士的想法。于是，王某某主动联系张女士，谎称自己认识朋友手上有U币可以交易，并谈定以6.35美元一个U币的价格交易，后让张女士转账人民币50000元至其指定银行卡账号内。

So, Mr. Wang, who volunteered to contact Ms. Zhang, falsely stated that he knew her friend who had a U.U. in hand, negotiated a deal at the price of $6.35 a U.S. dollar, and then asked Ms. Zhang to transfer the RMB 50,000 to her designated bank account number.

　　尔后，张女士迟迟没有等到泰达币入账，遂联系王某某。王某某先是称资金被朋友用于赌博拖延时间，后又向张女士货币泰达币账户转账7000多泰达币（相当于5万元人民币）后立即撤销，最后彻底将张女士拉黑。意识到自己被骗，张女士在家人的陪同下向公安机关报案。公安机关侦查发现，被告人王某某虚构可以帮助购买泰达币的事实，骗取被害人张某某人民币50000元，后将钱款用于还贷等个人挥霍。2021年9月，公安机关在浙江省杭州市抓获王某某。

After first claiming that the funds had been used by friends for gambling delays, Ms. Zhang’s money account was transferred to Ms. Zhang’s money in the amount of more than 7000 tadars (equivalent to 50 thousand yuan), she was withdrawn immediately, and Ms. Zhang was completely arrested. In September 2021, the public security authorities seized Wang in Hangzhou, Zhejiang province, accompanied by her family, and reported to the public security authorities.

　　在这起虚拟币诈骗案件中，检察机关积极履职，针对虚拟币交易平台隐蔽性强、存在技术加密等特点，第一时间引导公安机关及时有效固定平台电子数据等证据，严厉打击新型犯罪。同时，依托《关于进一步加强涉众型经济犯罪案件追赃挽损工作的意见》的制度优势，在侦查期间及审查起诉期间，以案释法，通过认罪认罚促使被告人退赃退赔，有效追回涉案全部赃款，最大限度挽回被害人经济损失。

　　2021年12月，无锡市新吴区人民检察院以涉嫌诈骗罪对被告人王某某依法提起公诉。考虑到王某某系初犯、偶犯，案发后积极退赔弥补被害人损失，综合其认罪认罚等情节，检察机关建议对被告人王某某判处有期徒刑一年六个月，可适用缓刑，获法院采纳。

In December 2021, the People’s Procuratorate of Noi Wu District of Si City filed a suit against one of the defendants, Wang, on suspicion of fraud. Taking into account the circumstances of Wang’s first-time offender, a co-perpetrator, who actively compensated the victim for his loss after the crime was committed, and combining his guilty plea, the Public Prosecutor’s Office recommended that one of the accused, Wang, be sentenced to one year and six months’ imprisonment, with a suspended sentence applicable to him, and accepted by the court.

　　近年来，随着经济社会的发展，涉及虚拟币、区块链等新型领域的犯罪案件频发，由于专业程度高、隐蔽性高，为检察机关准确认定案件事实及金额带来难题。无锡市新吴区人民检察院积极探索新型方式，通过把好三道关，解决金额认定难题的同时完善追赃挽损工作。

　　一是把好介入关，及时固定客观性证据。充分发挥提前介入的制度优势，针对涉及虚拟币的案件，及时引导公安机关对虚拟货币的网上交易、账目流水等客观性证据加以提取固定。

　　二是把好审计关，精准认定涉案金额。探索引入司法审计制度，借助专业优势，厘清涉案资金流向，破解检察实务难题。

　　虚拟货币交易炒作活动，扰乱经济金融秩序，滋生赌博、非法集资、诈骗、传销、洗钱等违法犯罪活动，严重危害人民群众财产安全。作为普通公民，应当充分认识虚拟货币的本质和风险，经受住诱惑和考验，不参与任何非法形式的交易、炒作活动，不轻信网络上所谓的专家、导师，选择正规的金融机构、交易场所开展投资经营。
