1、比特币投资目前在我国没有明确的法律确认其合法，也没有法律禁止比特币的发展，比特币仅仅是一种技术和方法，不存在是否是骗局的说法，但不同的比特币投资根据其形式不同，有可能是骗局，更有可能涉及违法犯罪。

1. There is currently no explicit law in our country that recognizes as lawful or prohibits the development of Bitcoin. Bitcoin is only a technique and method. There is no argument as to whether or not it is a fraud, but different bitcoin investments, depending on their form, may be frauds and are more likely to involve offences.

3、中国没有明确的证明比特币投资的合法性，也没有法律禁止比特币的发展。由于缺乏监管，其流通和交易形式大多类似于证券发行上市，存在设立交易所进行交易的行为。其交易过程和交易结果不透明，遇到问题时难以监管。

3. China does not have clear proof of the legitimacy of its investments in bitcoin, nor does it have a law prohibiting the development of bitcoin. In the absence of regulation, most of its circulation and trading forms are similar to the listing of securities.

4、不违法。比特币是一种由开源的P2P软件产生的电子货币，是一种网络虚拟货币，不依靠特定货币机构发行。法律并没有明文规定比特币违法，根据罪刑法定原则，比特币并不违法，但不法分子可能利用比特币从事犯罪。

不违法。1)就目前在中国大陆来说不违法的。挖矿机当然也不违法的，不然，用显卡挖的人，都把显卡没收了。2)五部委发的《通知》定义比特币为“特殊商品”，在自担风险的前提下，可以合法持有。

In accordance with the provisions of the Circular on Protection against the Risk of Bitcoin of the People's Bank of China, the Ministry of Industry and Informatics, the China Banking Supervisory Board, the China Securities Supervisory Board and the China Insurance Supervisory Board, Bitcoin does not have the legal status equivalent to currency and cannot and should not be used as a currency in the market.
